On Wednesday, Japhet Akawe told an Ogun State High Court about how Moses, a suspected armed robber, raped his wife on a farm in the Sagamu region of the state. Akawe, who was testifying in an ongoing trial of Moses over alleged rape and armed robbery, before Justice O. S. Oloyede went on to say that the defendant had allegedly taken his brother's motorcycle and the mobile phone of his wife. The witness stated that his wife, sister, and brother went to their farm to harvest cassava on March 18, 2023, while he was away from home, when the defendant attacked them with a gun.
He went on to say that his wife called him on March 18, 2023, using his sister's mobile phone, and told him that the defendant appeared to them while they were on the farm, snatched his wife's mobile phone, dragged her into the bush, and had sex with her illegally. Akawe said, “On March 18, 2023, at about 3 pm, I received a phone call from my wife through my younger sister’s phone and she told me that she and my younger brother, Joseph and his wife had gone to the farm to uproot cassava. She told me that the defendant forcefully snatched her phone, dragged her to the bush, forcefully had sex with her, took her naked picture and put pepper substance on her face.

“I called my friend to take her to the clinic where she was treated. The defendant answered my call to my wife's number and inquired about my dissatisfaction that he had not taken my wife before ending the call. “After that, the defendant called me with a number and warned me that if I called both his number and my wife's number, he would come after my family. Through my younger sister's phone, I called my wife the following morning to inform her to go to the police station and report that a criminal had stolen her phone so that she would be held accountable in the event of an incident.
He continued that following the incident, the owner of the motorcycle that was allegedly stolen from his brother charged his brother to court and he had to pay for the cost of the motorcycle before the case was struck out.
He continued, “On Thursday, March 20, 2023, the owner of the motorcycle which the defendant forcefully collected from my brother arrested my brother and took him to court.
He was granted bail by the court, but because I was not present, he was unable to comply with the terms of his bail and was sent to prison. "When I returned, I met with the motorcycle owner, negotiated with him, and paid him the money for the motorcycle before the case was dismissed in court." In addition, Akawe went on to inform the court that he had contacted the Sagamu Police Station about the incident and provided them with the phone number that the defendant had allegedly used to threaten him and his family.
Akawe emphasized that the number was tracked three months after being reported to the police, resulting in the defendant's arrest. D. was cross-examined by the defense attorney. O. Efuwape, the witness said he had not met the defendant before the incident.
When asked how he was able to identify that the defendant was the one who called him, Akawe said through the call the defendant made to him.
After listening to the testimony, Justice Oloyede adjourned the case to May 20, 2025, (today) for continuation of trial.
